New Sex Offender Rules Take Effect

Stricter new rules governing sex offenders are taking effect in North Carolina.

The News & Observer of Raleigh reported that the rules taking effect Monday triple the time from 10 to 30 years that an offender must remain on a state registry. Offenders also are required to register in person with the local sheriff within three days of changing addresses.

Offenders also are required to stay at least 300 feet away from a place where children gather, like day care centers and schools. One offender said his sheriff said he couldn't go to church because there was a nursery in the building.

The new rules were approved by the Legislature and signed into law by Gov. Mike Easley this year.

    Once a sex offender always a sex offender, they should stay on the register for life, but guess 30 is better than 10 years.

    Come on now Pat, how about a little sympathy.  These are people who have committed a crime, and then paid for it.  Besides, have you seen some of the high school girls walking around with their ho-ha and ta-tas hanging out?  They’re either 17 or 27 - who can tell?  And it’s parents like you who let them, and parents like you who are to blame.

    How am I to blame? For one my daughter does dress with respect, but that has nothing to
    do with someone taking sexual advantage of another person. Most of your sex offenders aren’t even charged and on the registry so you have no idea what you are talking about. Not only men are sex offenders either, some women are too and bc some girls let it all hang out is no excuse, if so every woman in Hollywood would be abused. THINK OF ALL THE INNOCENT LITTLE CHILDREN THAT GET SEXUALLY ABUSED EVERYDAY and sometimes murdered by the offender. Being on the registry is not going to stop them either, they shouldn’t be back out on the streets.

    Also meant to say I have no sympathy for any of them.  If they get to roam the streets after committing that crime they should have to work and pay for the victims counseling bc most of them get free counseling by the state and parents are left to pay for the victims. If you can’t tell a girls age then you need to leave her alone until u find out how old she is.

    What about the poor slob who was railroaded back in 1989 when he was 18 and his girlfriend was 16?  Just because her parents didn’t approve, he now has to sell his house everytime the local school district adds a new bus stop.  Even if the only student standing at it was his daughter.  You also aren’t including the dumb frat boys who streaked across the football field as a prank and are now permanently labelled “sex offenders”.  They really should stramline the laws so that only “predatory” sex offenders are limited.

    Well it is like this a sex offense is like any other charge. There are people on death row that should not be there too, but they had a trial and were convicted. You will not wind up on the sex offenders list just bc someone calls you a sex offender you have to be charged, AND IT IS HARD TO GET SOMEONE CONVICTED OF A SEX OFFENSE. Most of the sex offenders are out and about free with no shame, ABUSING LITTLE CHILDREN THAT ARE SCARED TO COME FORWARD. Check the news, weekly, u see someone arrested for sex offenses against small kids or people with child porn. Its kind of like a young guy takes his first few drinks at a party and drives away and kills someone, well he is doomed for life. Then u have this guy that gets drunk every week or day even and gets on the road but manages to not get in an accident but does get caught and has to pay for the crime in a lesser way in his eyes but they are both guilty and knew better, which one are u going to have sympathy for? If he killed someone close to u certainly not the one time drinker that killed someone.I agree it is sad for a young guy’s life to be ruined over sex with a slightly younger girl but if we have the law maybe they will know better and if he winds up with a child to support for 18 or so years he might rather choose being a sex offender. EVERYONE HAS TO BE TAUGHT TO TAKE RESPONSIBILITY FOR THEIR ACTIONS OR WE WOULD HAVE A MUCH MORE UNSAFE WORLD THAN IT ALREADY IS.

    I agree with Pat, I have NO sympathy for sex offenders. Although, I feel that it is very unfortunate for 18-16 year old relationships that get charged with statutory rape. A variance should be developed for this type of charge. As for the other sick, cruel, and control freaks that take advantage of any boy, girl, man, or woman will never get any graces from me. It is an incurable disease, there is no antecdote or cure.  This is backed up my much research.  It is also absolutely irrelevent of what a person is wearing! It infuriates me that someone would even think: that a person “asks” to be abused! There have been cases tried: an athletic runner raped; her running shorts were a “temptation”. The man was found GUILTY of rape. We have the right to wear what we want. Agreed, some styles may be too racey, but that entitles no one to assume and act on their presumptions; that because cleavage is showing, its out for the taking!

    Don’t do just love it when a woman wears a shirt with most of her boobs exposed, and then says something like, “my eyes are up here” to whatever male she is talking to.

    I love to snub those types of girls.  It destroys their self esteem.

    the way of the law is you do the crime, you do the time.  The issues with recidism has made us change the rules for sex violations.  Of course, this also catches 18 year olds caught having sex with their 16 year old gf/bf.  Or other cases which may mean a law was violated but there was no moral outrage really involved.  If we do not like the sentences handed down for sex crimes, then we need to change them.  Maybe a child rapist should fall into the same category as a murderer, which more likely than not results in life in prison.  To change the rules without respect for the law is not right.

    Besides that, I’d love to know if the legislature gave any money to these organizations to make sure these 30 year rules are funded so they can be upheld?  I’m willing to bet the legislatures voted to approve the popular law but gave it no funding or teeth - after all, paying for something isn’t popular, only demanding it.

    Shame on you North Carolina.Conformity with the federal Adam Walsh Act by stricter guidelines is all about the money the feds give out for conforming. Unfortunately,one time offenders who had an act of stupidity are caught in the same web as bonified predators and pedofiles. So 18 yr old having consensual sex with 16 yr old girlfriend is branded for life. The registry does nothing to protect children and elements of it including SORNA has been ruled unconstitutional by a Federal Judge in FL. NV and GA have cases pending.Our 18 year old who served his time and had to register once a year,now has to register twice and move every time a bus stop is changed.When sex offenders repeat only 5% of the time and drug dealers selling to sixth graders at the bus stop go free, where are our priorities. It might be politically safe for legislators, but it is flat out wrong for a civilized society.

    Pat, you’re an idiot.  Most Sex Offenders are on the registry for a non-violent crime, and 66% of them have never touched a child sexually.  You need to do some research dude.  The vast majority of sex offenders that DO harm children are FAMILY MEMBERS, or FRIENDS..  not the stranger danger that everyone is forced to believe.  Do your research an find the truth..

    And how is that again?  hard to convict?  Most 92% of all sex cases that make it to court are convictions.  In most cases, they are not even based on evidence.  There is no CSI sperm swab, not trace blood on sheets.  It is 16 year old saying he got me drunk, he forced me..  when in fact it is 16 year old partying, then waking up regretful that she slept with the ugliest boy in class last night, or told dude she was 23 instead of 15..  GET A CLUE PAT…

    If not, you will continue to be an idiot.

    @Melanie:  What recidism rate are you talking about?  Sex Offenders have the second lowest rate of re-offense.  Murderers being the lowest to re-offend..  Not sure where you got you information from..

    Check out the stat of Washington’s report on the matter, http://www.wsipp.wa.gov/rptfiles/05-12-1203.pdf reports a 3 to 6 % reoffense rate.

    the Department of justice, http://www.ojp.usdoj.gov/bjs/abstract/rsorp94.htm
    which shows a 5.3% rate

    So not sure what re-offense rate you are thinking of.  the RSO re-offense rate would be considered negligible, or insignificant if not for the minority of groups saying SAVE THE CHILDREN..  When the people they are telling to do as are the ones that actually abuse kids 93% more than strangers… I am not defending incest abuse nor am I defending abuse by a stranger, both are very very wrong.  However, I think the US needs to wake up and stop this idiot train in its tracks.  Politicians and media are self feeding their own numbers, which are lies to get votes and to sell stories.

    Actually those DOJ statistics aren’t accepted by anyone.  That study was done over a period of 3 years and does not reflect true recidivism.  Longer studies, specifically the one by Karl Hanson showed that 24% of sex offenders were reconvicted for a new sex crime within 15 years.  Sarah Tofte of the Human Rights Watch agreed.

    Furthermore, the majority of victims know their offender, but that doesn’t mean it is incest.  Nor does it mean they are close to them.  Sometimes it’s a neighbor, a Little League coach, a teacher, a baby sitter, a friend of the family, the childs friends relatives etc.  Knowing the offender in the majority of cases is proof that we need to be able to know who they are so we can avoid them.  They definitely do not need to be around children.

    One assault against a child and they need to be locked up forever. 

    Joseph Duncan who went on to kidnap Dylan and Shasta Groene and ultimately murdered Dylan after killing their mother, brother and family friend had this to say about his sex offender status:
    “The truth is I am not an exception, I am the rule! Most sex offenders are just like me.”

    Why give them another chance to victimize a child again?  Or murder her mother for trying to protect her? We must protect our citizens.

    That’s right Pat.  The majority of sex crimes are never reported.  Child molesters use grooming techniques on children, they also use intimidation and fear.

    When it’s a loved one committing the abuse the child doesn’t know what to do, they are in a dependent position.  We need to support them and make sure they never have to see their offender again.  And that includes in church or school.

    Thank you Stitches77. I just hope all these people in defense of anyone that would offend never have a victim of a sex crime bc the victims are the ones that have the life sentence. Registering is not a sentence only a title, just like a burglar breaks in a home and gets caught whether he chooses to do it again he will always be a burglar even if he pays for his crime. Those that think DNA should be a factor in every sex crime is wrong bc it is wrong to touch any child in an inappropiate way or expose them to porn and that will leave no physical eveidence but it does damage the child emotionally forever. Incest is the worst bc most children living in that situation are scared and ashamed to come forward. Those men or women that are having sex with teenagers and don’t want the title of sex offender should keep their pants on.

    It is interesting reading both sides of the fence.  Even more when you have been there.  I went to prison for 3-7 years cause my state has no statatory laws, just a straight felony charge, and I was blasted by the court.  It was consensual, I was 18 and she was 15, but at that age I didnt know it was illegal. I went to prison at 22 due to delays and by then had two kids.  After getting out, on parole, I won fully custody of my kids cause my ex lost them to the state. Now at 34, I have raised them and have a 9 month old, and all the states are making the rules you cant go where kids are, even if a court of law grants me custody of my kids after I was convicted.  Being in prison, I have seen some offenders who have done horrible things.  I have heard their stories and I believe in the registry, but I do believe also the country and states are going overboard.  Yes, there are people who BELONG on there.  I dont argue that, but why wont anyone steamline it to work, so that people can be informed and safe, but allow the lesser, who aren’t a danger, try to fix their lives? To be in my place, no one will hire you.  I have to Associate degrees not even having to do with any area of kids and I cant get a job, cause everyone does backround checks.  So, how do I support my family for something I did so young and didnt even understand the consequences..funny thing...cant use a polygraph to keep you out of prison, but that State of NH uses it to keep sex offenders in.  No one sees what happens ebhind the walls unless your there.

    I truly send my blessings to you Steve and hate to hear all you have had to indure and do hope things get easier for you. I agree with you our laws are very unfair and feel each case is different and should be treated that way, but unfortunately sex offenders aren’t and it is so unfair. I think most sex cases are serious and should be tried by jury. It would be worth getting more opinions on all cases so each one could be treated accordily. I would like to let you know that if my daughter were 15 and someone had consensual sex and were 18 I would not consider them a sex offender bc I feel a girl of that age is capable of making her own choices, but the wrong ones. Statutory rape is wrong but I do agree it is another category from child sexual abuse and certainly should be treated so. Any child abuse should be considered a capitol offense and tried by jury. I bet you can feel that my concern there with your own children. We have to stop society from harming children. May God Bless you and your kids and hope you have a wonderful Christmas.

    I believe with my own children and being on both sides on the fence, I have become very well educated.  I agree that as many children as possible should be protected, but that sad thing about the registry is...is it not so much the ones on the list you need to worry about....the ones you need to worry about are the people who arent on there. The neighbors, relatives, maybe a teacher.  Is there a good way to protect our children from the ones we can’t? I just think people need to be educated better.  The ones who make the rules are uneducated in the field of sex offenders and are running strictly on being scared of what they dont know.  A true sex offender is not the drooling at the playgroung.  If people do research, very few offend from a publlic place like a place ground.  Playgrounds are actually very safe places cause most sex offendeds are passive aggressive and careful. Only the very dangerous and rapist would fall under the agressive not care who is looking. I will never justify or stick up for anyone that willfully harms a child.  NH is now actually making a tier system where sex offenders can be removed off of the list if their offense deems it and they have some of the strongest rules for them.  I believe some are young and dumb and dont understand, as many of us were in our teens, but I agree there is many that should not be forgotten or forgiven.  Its sad but I just watched an 18 goto prison for a 15 year old and I warned him it wasnt worth it, but he loved her.  I truly believe he does, but at 18 your not mature enough to buy beer....but mature enough for prison...there is no justice there.  I hope everyone a happy holidays and be safe.

    1788 in France a batch of fools and clergy ran a country into the ground telling the plublic that they new better and somehow were wrong having lost their heads over lies just like this one. Some would like to beleve the use of laws in this manner have some validity but they don’t. Sex Offenders (so called by these idiot) like monsters in a movie built up by hype of a moral morjority using these laws have force people out of their homes, sold these homes to profit from their ill gotten gain and are crying now cause the money is running out. See just like France and many other countrys have found you just can not theve your way to wealth especialy when the class of individuals who are doing the steeling are steeling from their own countrys people. The facts are indisputable. My offence was now about 25 years ago and still creeps want to restrict internet access, so they can create some reason for disperity between classes. Look at these people who through pious thinking they are somehow better cause they do not have anyone who is willing to call them on their lies. Well I am here and calling you all liers and theves tettering on being clowns in habbit of looking down you noses at anyone not willing to bend to your think which is flawed and hurtfull. So anyone willing to beleve your tripe is dumb enough to allow a person to tell them they can never change. Un-exceptable and contrary to any healing, keeping a nation in its own vommet.

    i know a man in prison charged for aggravated sexual assault of 2 small children. the sad thing about it the charges should have been for exposure. one little girl pulled his pj down while he was putting the other child to bed. the little girl tells her mother she seen papa wewee (never came in contact of the child) a month later the step-papa was in a argument with the step-daughter she decides to tell him what her daughter tells her, he calls her bluff and goes to the sheriff office and tell them what happened and did not take into account it was election season and well politics wants to take sex offenders off the street, no he never had a criminal record and the little girl tells authority she was just trying to get papa to ride her on his leg before he put her to bed and yes authority called it a confession. he is serving 15 years go america

    no not nc. but wherever each case handled by jury maybe the only way.  when a person has never been involved with the court system and is naive to think that politics isn’t involved then their rights and the law gets bent. fear and the threats from a judge that may have motives that has nothing to do with justice can be a combination not easily solved.  what we experienced was not only sad but distasteful to say the least. but because this happened to me and being on the front seat of this train wreck i can say with evidence.  everything that is being done thus far is not it! no my husband was and isn’t a sex offender but the law says he is.  so i study up on what was a sex offender or the other legal terms they call them and i learned that most of the people that is scarred with this label now, did not have the past to be given such stiff sentencing. the ones that are actual victims what responsiblity did you play and making the child available ouch! i know how dare me.  if i told my complete story then the question would be more exceptable.  my 2 grandchildren were never sexually abused and the only man that treated them with love is in prison for?  there mother well remorseful and still leave my grandchildren with whoever she can. if you think or concerned about a love one behavior around children talk to them and instead of treating the person like they are inocent how about taking the responsibility and make sure the person isn’t harming no one.  that is my opinoin in dealing with this.  i raised 4 girls alone and has always watch others around them.  so i am not naive about what happened and fully sure of what was going on in the bedroom. you people with children watch them and stop holding the public hostage in keeping them safe, they are your’s! everyone knows that there are sick people in society, what opportunities are you providing them?
